Sažetak

Regulation 261/2004 was a further step in the promotion of rotection of passenger rights in the European Union. The author examines the development of the institute of air carrier liability for damage in
the European Union, paying special attention to Regulation 261/2004, which came into force on February 17th, 2005. Emphasis is placed on the need to harmonise domestic law with the solutions provided
for in the Regulation, in accordance with obligations imposed by the Stabilisation and Association Agreement. The need to introduce objective liability of the air carrier for death and physical injury, as laid down in the Montreal Convention and Regulation 889/2002
which implemented the provisions of the Montreal Convention in the UnionÕs secondary legislation, is pointed out.
