Rights, Justice, and Human Rights in the Light of Prohibition of Discrimination by the European Convention

Sažetak
The subject of this paper is rights, justice and human rights in the context of contemporary institutionalized prohibition of discrimination, which is most concisely defined in the European Convention for the Protection of Human Rights and Fundamental Freedoms. It starts from an important principle that human rights and fundamental freedoms are the basis of justice and peace in the world, and that rights, justice and human rights are best protected by a genuine political democracy on the one hand, and a common understanding and respect of these values upon which depend their application in life, on the other hand. In this sense, we consider the beginning of the design of political and legal framework for defining these rights, as a precondition for their final institutionalization in one legal and political document, such as the European Convention. Finally we consider the causes of violations of the Convention’s prohibition of discrimination and the need for legal and political struggle for existence of the application and further development of human rights and freedoms.
