Sažetak

This article analyzes the constitutional design in Bosnia and Herzegovina. Key point presents the idea that the results of the elections and disfunctionality of the state are consequences of the original constitutional design and the process of institutionalization of it. Following this idea, the author seeks to explain possible alternatives to the present constitution. While consociational arrangements seem appropriate for implementation in Bosnia and Herzegovina, the asymmetric division of power prevents its full implementation. On the other hand, the integrative model seems more appropriate as the idea of the international community was to establish strong state institutions. However, this model does not suggest any practical measures for achieving such a state as it was only developed as a criticism to the consociational model. Finally, the author analyzes possible constitution changes, particularly from the regional and international perspective.
