Authentic Interpretation in the Croatian Parliamentary Law since 1947

Sažetak

The paper outlines the development of authentic interpretation in the Croatian parliamentary law from 1947 to 2016. The influence of previous regulation of authentic interpretation on the current legal solution is analysed by comparison of previous and current rules of procedure of the Croatian parliament. Special attention is devoted to constitutional authorisation of the Parliament to issue authentic interpretation, because current Rules of Procedure explicitly mention
such competence, while there is not any related provision about authentic interpretation of laws in the Croatian Constitution. Rules of procedure applied before 1990 are systematized into four periods, 1947-1953, 1953-1963, 1963-1974, and 1974-1990. These periods correspond to the adoption of three versions of the Constitution and one constitutional law. The paper identifies three periods
after 1990, 1990-1992, 1992-2000, and 2000-2013, which correspond to different structure of the Parliament (tricameral, bicameral, and unicameral). Current Rules of Procedure, adopted in 2013, are analysed according to their respective regulatory content. The professional critiques and the position of the Constitutional Court are pointed at together with some comparative examples.
