Theoretical Foundations for Evaluating the Legal Aid System and Their Application to the Current Regulation In Croatia

Sažetak
Rawls revolves around the adaptation of two fundamental principles of justice which would guarantee a just society. The basic idea of Rawls’ principles is that the well-being of each citizen depends on the scheme of cooperation without which no one can have a satisfying life. Rawls claims that without the assumption of citizen cooperation it is not possible to imagine the realization of a just society. In the context of Rawls’ idea that every citizen should create the conditions of equal opportunities for exercising his rights and freedoms, the author in this paper examines whether and to what extent the Croatian legal aid system follows Rawls’ principles of justice. In this paper the author will give projections de lege ferenda as guidelines for establishing a just legal aid system based on the idea of social cooperation and solidarity with the aim of achieving equal opportunities for citizens to be treated fairly according to the law.
