Status and organization of Croatian townships under the Statute on Ordering the Township Municipalities of 1881

Sažetak

Following thè failed attempi to make an autonomous statute on ordering thè Croatian townships during the period from 1848 to 1849, the adoption of thè township Orders would be achieved by the ruler’s régulations of 1850 -1851. The intention io regulate the townships on a municipal basis at the session of the prematurely dissolved Croatian Parliament (Sabor) of 1861 remained unrealized as well. Thus, a modern ordering of the townships, within the framework of the autonomous Croatian législation, occurred for the first time in 1881 by the Statute on Ordering the Townships, which had been prepared at thè end of the period of the Viceroy (Ban) Ivan Mažuranic administration (1873 - 1880).
The bill proposed by thè government had foreseen a significant degree of seif - governing jurisdiction; the supervisory authority of the government over those townships; a double - track of the mayors activities, in the autonomous and in the devolved jurisdiction; and the provisions regarding the skill requirements for thè mayor and the township officiais. The maintenance of the township autonomy was at thè center of the parliamentary discussion ofthat Bill.
The deputies succeeded to reject the governmental proposai to widen the circle of mayoral candidates over the scope of the township représentation, as well the requirement ofskill for candidates for the position, because they had deemed it as an actual dímínuation of the township autonomy and the role of the township représentation. The deputies also forgeđ io introduce the active voting right for women at local élections, in order to strengthen the social hasis of thè township self- government.
However, the strengthening of the governmental authority towards the townships and a repeal of the women’s voting rights would take place already in 1886, under the Hungárián Viceroy Khuen Hedervary. The content of the Statute on Ordering the Townships of l881 was in its greatest part dedicated to the questions of authority, but the régulation of the municipal issues has been more developed then in the previous régulations, which corresponded to the tendency expressed by the Mažuranić’s reforms. One among its dimensions the Statute had, unexpectedly, obtained within thè scope of the Croatian - Hungárián relationships, since the Parliament had, on insistence ofthe Central Government, to restrict the autonomy of the townships to de fine the sources of their income in order to sustain the taxing capacity of the population.
