Liberalization Of Network Industries and Public Regulatory Function

Sažetak

A political and economic background of liberalisation of network industries in European Union and Croatia is presented. The result is a changing role of the Government in the market economy and the rise of regulators as a new generation of public authorities. Their undefined position in the constitutional order raises questions related to delegation of public powers such as law-making, dispute settlement, sanctioning of undertakings, etc. Their legal independence and interdisciplinary specialization allows for regularly adapted regulation of market conditions and prompt response to competitors and consumers’ needs. However, this does not necessarily remove all risks of undue political and corporative influence. Their proliferation over time, growing competences as well as compatibility of competences in market liberalisation and protection of market competition, allow the research of new models of governance, furthering impartiality and balance of the public and private interests in a market economy.
