Sažetak

The paper analyses the provisions of Chapter V Part IX of the 1994 Croatian Maritime Code devoted to the extracontractual liability of the shipowner and the ship operator.
Chapter V comprises provisions on liability for loss of life and personal injury, for damage made to things and environmental harm caused by substances other than oil, and for pollution damage caused by escape or discharge of oil from ships.
The author analyses the provisions of the Chapter V, especially emphasizing the improvements made to the relevant provisions of the former 1977 Maritime and Inland Navigation Act devoted to the same subject-matter.
Stressing that the 1994 Code takes over the most modern solutions adopted at the international level and in general could be considered as a very successful act, the author nevertheless suggests some changes and amendments to the Code which would, in her opinion, contribute to its further improvement.
