New International Convention on Salvage at Sea

Sažetak

At the Diplomatic Conference, held in April 1989 in London, a new International Convention on Salvage at Sea was adopted. This Convention supersedes the International Convention on Assistance and Salvage at Sea, adopted in Brussels in 1910.
There are some very important innovations in the new Convention. Besides the salvage at sea, the Convention shall apply to salvage in any navigable or other waters. Objects exempted from its application are listed. Freedom of contract is enlarged, but the principle of equity of contract and the duty of the parties to prevent or minimize damage to the environment are preserved. The duties of the salvor and of the owner and master of the vessel in danger are listed. The right of coastal states to take measures to protect their coastlines from pollution and to give directions in relation to salvage operations are recognized. The payment of a special compensation to salvors, according to established criteria is provided for. Salvor's maritime lien under any international convention or national law is recognized. And so on.
