A Political-social View on Subsidiarity. Theoretical Foundations of Subsidiarity in Social and Political Life

Sažetak

Many European countries have turned down the path of adopting the principle of subsidiarity both within their intrastate and political order as well as in their relations with the international community, particularly the European Union. The author endeavours to present briefly the principles that follow this process of adopting subsidiarity, particularly with regard to the experiences of our neighbouring countries. Even though social teachings of the Church have for the past one hundred years -implicitly from the great encyclical »Rerum novarum« and explicitly in the encyclical Quadregesimo anno - been referring to the principle of subsidiarity as the fundamental principle of socio-political life, only recently has it been given attention. Special attention is directed to those aspects where fundamental expressions of social teachings need to be supplemented - keeping in mind the current situation of modern and post-modern society. Globalisation is the main driver of interest for the principle of subsidiarity because it sets new criteria for life as a whole, compared to those that have been valid until now. That is the reason why the European Union is reaching out for the principle of subsidiarity; otherwise, a community without any competency or a global super-State that negates any kind of sovereignty would remain as the only possible alternatives. The other driver of the reform oriented toward the subsidiarity is a crisis of the social state and of its models of establishing social equality which led to the creation of new models. Special attention is dedicated to the significance of subsidiarity in the political order of the state, i.e. to the defining decentralisation and federalism. The main barrier to establishing subsidiarity is often the lack of clear legal regulations. The author directs particular focus on the possibility of establishing the principle of subsidiarity in social policies where various models exist, depending on the milieu and the historical background. The key to successfully establishing the principle of subsidiarity is to value all segments of civil society because this is where the needs of applying subsidiarity are best shown, i.e. in its negative and positive dimensions. The author endeavours to present principles, though with the intention of them serving as a parameter to apply the principle of subsidiarity in Croatian society.
