Sažetak
This paper deals with the transformation of the social ownership of things which were not assessed as part of the social capital during the transformation of social enterprises. After the conduct of transformation of social enterprises, pursuant to the Act on Transformation of Social Enterprises, there was a dilemma in theory and in practice relating to acquisition of the right of ownership on such things. This primarily related to the application of the Privatization Act, which did not regulate clearly the procedure for acquisition of the right of ownership on such things, which was reflected mostly in different procedures in the courts for registration of the right of ownership of unassessed real properties in the land register.
Therefore, the subject of examination in this paper is the historical legislation relating to regulation of this issue, with a presentation of differing theoretical interpretations and practical procedures by the courts. In the introduction there is a presentation in general of the transformation of social ownership of things, and the fundamental goal and purpose of the paper is to give a complete presentation of the procedure with things which were not assessed during the transformation of social enterprises, and resolution of any remaining dilemmas in that procedure.
