Why Yugoslavia has not ratified the Hamburg Rules?

Sažetak

The 1978 UN Convention on Carriage of Goods by Sea (the Hamburg Rules) has no dar been ratified by 14 countries representing an estimated 2 percent of world trade. Twenty notifications are required for the Convention to come into force, and it can be expected that this will happen in 2 or 3 years.
The author explains the reasons for revision the Hague Rules, the main principles of the Hamburg Rules and examines pros and cons for it's acceptance. He also analyses the recent studies and meetings of the IMC about the uniformity of the law of the carriage of goods in the 1990s and comes to the conclusion that at this moment Yugoslavia should ratify the Visby Rules because the Hamburg Rules may seriously affect the risks borne by shipowners and carriers of the Yugoslav ageing merchant fleet.
