Legal Inconsistency versus Legal Certainty - Name and Gender in Private International Law of Bosnia and Herzegovina

Sažetak

Name and gender are important determinants of a person’s identity, and it is reasonable and justified for an individual to have these facts recognized even outside the borders of the country in which they were acquired. Uneven case law in Bosnia and Herzegovina indicated the need for a more detailed analysis of the national, comparative, convention and EU legal framework. This analysis, as well as the justified expectation of continuity of status - name and gender - pointed to the need to find a balance between evident legal inconsistency and preserving legal certainty, in order to offer solutions that are in line with the parties’ expectations, all with the intention of avoiding “limping” status relationship.
