Overview of Selected Administrative Process Specificities in Procedures Before the Croatian Competition Agency

Abstract
The paper provides an overview of selected legal institutes of administrative procedure and their specificities through a normative method based on valid legal regulations - the initiation of administrative proceedings based on a notice or petition and a special administrative procedure of the initiative submitter, and the issuing of warrants for unannounced searches by the High Administrative Court of the Republic of Croatia. Furthermore, a comparison is made of their legal regulation according to the General Administrative Procedure Act, Competition Act and Administrative Dispute Act, and certain vagueness and deviations are pointed out. Statistical data of the administrative practice of the Croatian Competition Agency and the case law of the High Administrative Court of the Republic of Croatia are also presented. Likewise, by referring to the comparative solutions derived from the case law of the Court of Justice of the EU and selected courts of other member states in relation to unannounced searches, an attempt is made to find answers to certain open questions in practice, in the area of administrative-procedural actions of the Croatian Competition Agency and decision-making by the High Administrative Court of the Republic of Croatia. Finally, in the conclusion the authors present their considerations in relation to the analysed institutes, including a critical review.
