Challenges of the Effective Protection of Platform Workers from Psychosocial Risks

Abstract
This paper analyses the psychosocial risks faced by workers working through digital platforms. Although international, European, and Croatian legal frameworks establish a foundational structure for the protection of platform workers, their effectiveness in addressing psychosocial risks remains limited due to conceptual ambiguities concerning employment status and the constantly evolving nature of algorithmic management. Specific modalities of platform work – such as realtime digital surveillance, algorithmic performance evaluation, automatic account deactivation, and fragmented working time – require further regulation. Ensuring effective protection against psychosocial risks calls for a coherent, multi-level regulatory strategy capable of reconciling technological innovation with the fundamental principles of occupational safety and health protection. This paper contributes to ongoing doctrinal and policy debates by identifying regulatory gaps and proposing de lege ferenda measures aimed at strengthening the protection of psychosocial health in the context of platform work.
