Sažetak

The problems of antitrust legislation in the countries of the European Union and Croatia are analysed, with special regard to the issues subject to regulation. The analysis starts from the historical development of the right to the protection of market competition in the mentioned region with the presentation of contemporary tendencies and guidelines. From the legal standpoint, Articles 85 and 86 of the Treaty of Rome are specially analysed as bases for all subsequent legislative solutions. A brief outline of the Croatian Market Competition Protection Act gives an overall presentation of solving controversial situations in the market, by which nowadays the possibility of equal participation is constantly being denied to a large number of economic subjects. The macroeconomic background of antitrust policy reveals all the substantive causes of market mechanisms which need regulation. Only by understanding economic developments it is possible to solve the problem of market inequality and improve the conditions of market competition.
