Rules Governing the Administrative Proceedings in the European Law

Abstract

The aim of this article is to determine legal sources which regulate the administrative proceedings in the European Union Law. The author in the article makes efforts to identify no more than legal sources for general administrative proceedings without entering into the special administrative field. Moreover, he endeavours to single out the basic requirements which have to be fulfilled by the institutions and bodies of the European Union while exercising their powers as well as by the Member States while applying the material provisions of the European law in administrative matters to decide about rights, obligations and legal interests of the individual. In final remarks, the authors defines a necessary content of the above mentioned requirements as it has been defined by the legislation of the European Union as well as by the court practice.
