Constitutionalism and Democracy in Contemporary International Community

Abstract
Starting from the insight that jurisprudence of legal theory should be concerned primarily with,on the one hand, international law, and, on the other, constitutional developments, the paper; analyzes some prominent conceptions of constitutionalism and democracy in international community and municipal legal orders; formulates a new set of criteria for the analysis of constitutionalism and democracy in international law; and argues that Laswell and McDougal's policy oriented jurisprudence offers the best account of constitutionalism in international community, while Lea Brilmayer's view of self-determination provide a key to a proper understanding of democracy in international community.
