Abstract

Insurance contracts concluded with consumers belong to one of those types of contracts where the asymmetry between rights and obligations between parties is evident. In order to eliminate that asymmetry and to ensure the proper functioning of the internal market it is of utmost importance to provide consumers with the adequate level of protection. In this paper the author deals with the legal framework of such protection in Croatian law and analyses the main mechanism of consumer protection such as the pre-contractual information duties, protection against unfair contract terms, the meaning of general and/or specific insurance terms and conditions, the legal rules on the payment of insurance sum, and finally control over marketing, distribution and the content of additional materials which support insurance contract.
