Abstract

This review, written on the occasion of the publication of the book “The Kanun of Leke Dukagjini”, deals with the origin and preservation of the Albanian common law. After presenting some general characteristics of the Albanian common law, the text defines it and indicates the differences between morality and law, placing common law in a social and historical context. Conditions bearing upon the origin, extinction or preservation of old institutions are outlined. The review focuses on those specific (geographical, social and historical, material and cultural) factors whose mutual interaction contributed to the preservation of the kanun. After a comparison with other statutes and common law codes, special attention is paid to the most important institutions of common law that through many centuries helped form the specific identity of the Albanian nationality.
