Abstract

This paper analyses the system of the technical inspection of motor vehicles in the Republic of Croatia from the perspective of competition. After a detailed overview of the technical inspection system and an analysis of the provisions of European and national competition law, the thesis is established that the above tasks are not regarded as an entrepreneurial economic activity. For this reason, they are not covered by the competition legislation. Such a conclusion is based on the case law of the Court of Justice of the European Union, which set precise guidelines when establishing the scope of the provisions dealing with competition. With regard to this, the author presents theoretical explanations, as well as the advantages and disadvantages of such a technical inspection system, along with a comparative-law analysis. The concluding remarks in the paper are also applicable to other tasks and legal areas where the application of the provisions related to competition might be contentious.
