Abstract

This paper presents a short review of the ISM Code, specially regarding its application in marine industry. The first part of the article gives basic information about the Code and the certification, while the second one emphasizes very important role of the flag state in the whole process of implementation of the system. It is also pointed out the lack of effective legal sanctions if there is an evidence of non-comformity within the ISM Code. In addition that issue brings us to the problem of implementation of the Code in practice, specially in the cases where classification societies and flag administrations fail to maintain new standards, so the port state control becomes the only possible instrument of effective control. Although the flag state administrations bear the principal responsibility for the effective application of safety standards originated from provisions of the international legal instruments, the above mentioned issues open new aspects of the port state control in order to provide standards for safer ships and cleaner seas.
