Legal Regulation and Implementation of Administrative Supervision of Chambers in the Health Sector

Abstract

Chambers are autonomous professional organizations vested by the state with certain public authorities such as general acts passing, control of the entrance into the market, professional supervision of service providers and others. Since those are transferred authorities, i.e. entrusted state administration activities, state administration bodies perform administrative supervision of public authorities transferred to chambers. In the paper, legal regulation and execution of administrative supervision of chambers in the Croatian health sector are analysed. Certain inconsistencies in legal regulation of public authorities among different chambers are indicated. Alignment and improvement of relevant legislation are needed. Besides, administrative supervision should be executed regularly and continuously in order to realize preventive and educational functions of supervision to a higher extent. In doing so, it is important to respect the autonomy of chambers and administrative supervision to be executed exclusively over the performance of public authorities.
