ACT ON GENDER EQUALITY- REASONS FOR ADOPTION AND INSTITUTIONAL MECHANISMS FOR ENFORCEMENT

Gender equality is one of the highest values of the constitutional order in the Republic of Croatia and one of a foundations for interpreting the Constitution of Republic of Croatia. By the time the fi rts Croatian
Act on Gender Equality entered into force, gender equality in the Republic of Croatia was regulated primarily by the Croatian Constitution and international treaties that were a part of internal legal order. The mentioned Act on Gender Equality lays down a general framework for the protection and promotion of gender equality as a fundamental value of the constitutional order in the Republic of Croatia and it defi nes and regulates the method of protection from discrimination on the grounds of sex and establishment of equal opportunities for women and men. In the year 2008, on the day that the Act on Gender Equality from 2003 ceased to have eff ect, a new Act on Gender Equality entred into
force with the same subject matter. The one is still eff ective. The author’s intention is to present circumstances that lead to the adoption of the fi rts Croatian Act on Gender Equality as well as the circumstances that lead to the adoption of the Act on Gender Equality that is eff ective today and to present a way in which the valid Act is being enforced, with a particular retrospect on available data on gender
equality in the Republic of Croatia and measurments that are being taken in that area.
