Health as legal value and health factors

Abstract
In the first (introductory) part of the article, we state how people generally understand health.
In the second part of the article, we start from the division of legal sources into material, formal,
ethical and cognitive and consider health as a type of ethical sources, that is, as a legal value. At
the same time, we consider health as a non-specific legal value, that is, a value that is inherent not
only to law, but also to other normative orders - morality and customary law. In the third part of
the article, we list two basic ways to protect health - using official (conventional) and alternative
(natural) medicine. We present the arguments of supporters of one and the other medicine. We
briefly describe some of the most widespread and/or successful methods of alternative medicine.
Furthermore, health protection is regulated by numerous regulations. We list the regulations of
constitutional and health law, but also of other legal branches, which in many aspects protect health
- food law, environmental law, and criminal law. These regulations are the formal sources of the
aforementioned legal branches. The fourth part of the article starts from the fact that there are several
health factors, the requirements of which, if we adhere to them, we will not get sick or will not get
sick more. These are: nutrition, air, liquid, movement and exercise, sun and rest. In the fifth part
of the article, we conducted, using the survey method, research on ten respondents, whether and to
what extent the respondents adhere to the requirements of health factors and thus take care of their
health. The sixth part of the paper is the conclusion.
