The business of football intermediaries or football agents, as they are most often called in international communication, is one of the crucial issues related to the system of football transfers. The legal regulation of the profession of mediator in football at the national and international level is necessary in order to increase financial and administrative transparency in transfers, and especially to protect those players who do not have experience in contractual relations with representation and to prevent unfair practices in connection with transfer system. Intermediaries in football have become an inevitable part of the system of football transfers without which players, football clubs, federations and other important stakeholders of the sports system cannot function, as a result of which FIFA adopted a new Rulebook on football agents in December 2022, while HNS its general act, the Rulebook on intermediaries in football adopted on September 8, 2023. The aforementioned regulations at the international or national level regulate the procedure for obtaining a license and the activities of football agents or intermediaries in football and their clients, and regulate the method of payment and limits of compensation paid to the intermediary for the performance of services provided on three percent of the commission for a player who earns above 200 thousand dollars per month or six percent if it is a matter of dual representation, and five percent of the commission for those players who earn below 200 thousand per month. The main novelty is the mandatory licensing system in such a way that those who want to represent players must first undergo a certain education and pass a written exam along with paying an annual membership fee to FIFA and publicly announcing their transactions.
