COPYRIGHT AND FREE USE OF COMPOSITIONS IN THE MUSIC THERAPY PROCESS

Sažetak
The general elements of the use of songs in music therapy were presented in this paper. The basic concepts of music therapy are presented in the introduction, while the role and use of songs in the music therapy process are described in the first chapter of the paper. The second chapter elaborates copyright laws in Croatia and Bosnia and Herzegovina for compositions written for free use, while the third shows practical examples and reproduction of compositions used during music therapy sessions. The conclusion clarifies guidelines for possible amendments to the Copyright Law in Croatia and Bosnia and Herzegovina, and the conclusion is followed by an overview of literature. Since the creation of songs (songwriting) is one of the techniques within the model of creative music therapy, the need to research ways of legal protection of compositions used and created in the therapeutic process, in the territory of Bosnia and Herzegovina and Croatia, proved to be necessary. In order to make the laws on the protection of compositions used for therapeutic purposes even clearer, in consultation with legal experts and experts in the field of copyright, the recommendation is to amend the existing Law on Copyright of the Republic of Croatia with new articles or acts that allow the free use of compositions created during education for practical application in the music therapy process, which would encourage the creation of new and protection of the existing pieces of music of the active music therapists.
