Sažetak
An adequate space for storing and safekeeping of weapons is one of the general conditions, namely, preventive measures that a person must fulfil when acquiring and owning weapons. It is an imperative measure that ensures that unauthorised persons from the holder’s surroundings do not come into physical contact with the weapon and consequently cause the misuse of the weapon. By comparing the current Law on the Acquisition and Possession of Weapons by Citizens with the previous Law on Weapons, it is evident that the legislator’s approach to the latter is a liberal one. The legislator considerably relaxed the rules by abolishing the mandatory verification of the above-cited condition by police officers during the acquisition of weapons. The legislator simply left the possibility of the said verification only as an exception to the general rule. Accordingly, instead of checks carried out by police officers, gun owners are now simply required to sign a declaration stating they meet the requirements for safekeeping and storage of weapons. However, when it comes to the storage of weapons by legal entities, the legislator takes a considerably more rigid approach and therefore, both in laws and by-laws, prescribes a number of minimal, both technical and other conditions these legal entities must meet in order to store weapons properly. This paper is thematically divided into introductory considerations, the central part of the paper, which is concerned with the analyses of the safekeeping and safe storage of weapons by physical and legal persons (with special reference to the possible change of de lege ferenda), and finally the concluding remarks.
