Abstract

The presented results are part of the scientific research project Croatian Violence Monitor – Study of incidence patterns, causes, and prosecution of delinquent violence with a focus on protecting particularly vulnerable victim groups. The research sample was based on secondary data sources, specifically court cases of violent crimes committed within the territory of the Republic of Croatia. The conducted research aimed to gain insights into certain characteristics of the course of criminal proceedings and to gain insight into the type of violence committed by the perpetrator, measures to ensure the presence of the defendant, the defendant’s plea, psychiatric expert evaluations, criminal responsibility and form of culpability. The specific goal of this research is to determine whether there are differences in these characteristics depending on the legal qualification of the most serious criminal offense. The conducted research provides valuable feedback and insights for theorists, practitioners, and other professionals engaged in various aspects of criminal proceedings, particularly regarding the practical application of measures to ensure the defendant’s presence during criminal proceedings, such as detention and custody. Moreover, this paper offers an overview of how defendants plead, the current practices concerning the ordering and execution of psychiatric evaluations, as well as assessments of their criminal responsibility and the form of culpability.
