Use of Electric Stun Devices in Law Enforcement in the Republic of Croatia: A Case Study

Sažetak
This paper presents a systematic overview and analysis of all known cases to date involving the use of electric stun devices (ESDs) as a police use-of-force instrument in the Republic of Croatia. The primary aim is to evaluate the legality, justification, and effectiveness of this measure and to formulate relevant recommendations. The study comprises ten cases involving members of specialised police units recorded between 2010 and 2021. The analytical framework is structured around five categories. The first category pertains to an individual against whom the ESD was deployed; the second examines the circumstances surrounding the use of ESDs; the third analyses the manner of ESD deployment; the fourth addresses injuries sustained by police officers during the intervention, as well as injuries incurred by individuals subjected to ESD use; and the fifth evaluates the legitimacy of its application, specifically compliance with applicable legislation, guidelines, and operational protocols. The findings indicate that, in all examined cases, the use of ESDs was lawful and justified, with no injuries attributable to the devices themselves. Nevertheless, the analysis reveals normative deficiencies and ambiguities in their practical application. The paper concludes with recommendations for improving the existing legal framework and enhancing police practice.
