Abstract

By analysing viewpoints of legal theory and the decisions of the Administrative, Constitutional and European Human Rights Courts, the author concludes that giving testimony before a body which is holding disciplinary proceedings against a police official, if the material truth can be established by other means of evidence (including also the written form in which the testimony of the witnesses is contained,) is not always possible or mandatory, but the official against whom the proceedings are being held must be allowed to respond to all the evidence used in the examining procedure.
