Abstract
The administrative judge plays or should play a significant role in the important areas of protection of fundamental human rights and public interest. Through this, the judge is closely linked to the application of law from the European Convention on Human Rights and Fundamental Freedoms. The European Convention for protection implies forbidding the abuse of power (detournement de pouvoir) in the sense of the right of the signatory- country to impose limitations on the rights and freedoms which the convention guarantees.
