A Comparison of Geographical Indications and Trademarks in Conceptual Terms and with Regard to Internationally Accepted Standards of Protection

Abstract
This paper deals with similarities and differences between geographical indications and trademarks. Geographical indications and trademarks are compared in conceptual terms, and various situations in which marks may contain a geographical term are referred to. Simple geographical indications and qualified geographical indications are defined and international accepted standards of protection of the latter are examined. The author presents the different approaches and ways in which countries protect geographical indications, analyzing the basis of the conflict present on the international scale between the countries that protect geographical indications solely within their trademark laws, and those that are advocating their enhanced protection as sui generis industrial property rights.
