Abstract

The paper deals with legal conditions for granting firearm certificate to a natural or a legal person, a procedure to seize firearms, ammunition and revoke firearms cerificate from a natural or a legal person that ceases to fulfil conditions prescribed by law. In addition to specific legal institutes the paper deals with mostly unpublished but relevant court rulings. The body of authority to grant firearm certificate and seize firearms in administrative procedure is a police department, police office of the requesting party residence; its decision is a first instance administrative act and the Commission for Complaints appointed by the Croatian government decides in the second instance. Firearms are dangerous and in this context the legislator has passed strict legislation with reason: strict conditions for possession of firearms and provisions enabling the authority to take a quick action in order to prevent firearms abuse. Statistic data confirm, as published in this paper, that a great number of persons legally possess firearms but there is also a certain number of persons who do not fulfill conditions for granting firearm certificate i.e. a certain number of persons cease to fulfill conditions for possessing firearms with time.
