Abstract

Abuttal represents a demarcation line on soil within which an owner has a full legal power over his real estate. Abuttal, the border of a cadastre unit, is marked with abuttal signs. In case abuttal signs become non-recognizable (due to elapse of time, weather conditions, etc.), abuttal should be repaired, reconstructed or even rearranged, depending on the level of damage and recognizability, and depending on whether its position is disputed. Establishing of abuttal is dealt with in non-contentious proceedings. The Republic of Croatia still does not have a law on non-contentious procedure, therefore provisions of the old 1934 Law on Non-Contentious Procedure are applicable as separate legal rules.
