Abstract

The protection of women during pregnancy and maternity, as a special category of workers, is part of acquis communautaire. Although the EEC Treaty contains only one regulation regarding gender discrimination, the present-day legislation of the European Union, with the exception of the founding treaties, regulates the discrimination related to employment and work in greater detail by means of secondary legislation. The rights of pregnant women and women who have recently given birth or are breastfeeding are regulated by many directives to which the legislation of member states has to be adjusted. This work deals with the legal foundation of the protection of maternity, that is, parenthood in the European Union as well as the legal foundation of protection in the Republic of Croatia. The work questions the level of legal protection of pregnant workers and those who are breastfeeding in the Republic of Croatia, which can lead to indirect discrimination in case other social elements are missing.
