TERRITORIAL REFORM OF THE CROATIAN LOCAL AND REGIONAL SELF-GOVERNMENT: CONSTITUTIONAL PREREQUISITES

Abstract
Starting from the thesis that in the Republic of Croatia the time has (finally) come for the radical reform of local and regional self-government in generaly, and especially for the reform of the established areas of local and regional units, the author emphasizes the question of constitutional requirements for the territorial reform. Because of the fact that in the context of the territorial reform we shoul start from the constitutional provisions, this paper analyzes relevant provisions of the Croatian Constitution, and of the European Charter of Local Self-government, the Law on Local and Regional Self-government, and of the other relevant legal sources. The author concludes that any change in the area of local and regional units should include prior opinions of this units inhabitants and that the way to obtain this opinions may only be (local) advisory referendum.
