Abstract

The contracting of Paramount clause does not mean that the limitation sum of the Hague Rules must be applied. Yugoslav law should be applied if the conditions for application of that law are met. The operator's unlimited liability does not exist in case of his actual fault or privity if he himself is the owner or the holder of the right to dispose of a ship. The costs of the diminution of the damage of cargo are the part of limitation amount of the operator's liability.
