Abstract

A dangerous material in legal terms is defined according to an objective criterion with regard to characteristics of the concerned material, and not with regard to the current psycho-physical condition of the person using it. A ship as a whole is not a dangerous material, but in certain circumstances it may be regarded as such, and certain activities performed on board a ship may be considered dangerous too, depending on the circumstances in which these are performed. The work on high, wet and totally verical ladders (without an inclination angle), poses a risk of slipping or threat to health or life of the person performing such work, regardless of the degree of care exercised during the work (climbing or descending). Use of such ladders in the circumstances as described above is dangerous to health and life of the user, therefore they have all the characteristics of a dangerous material.
