Abstract

In this paper, the authors analyse specifi c issues of non-compliance in the
registration law, namely, the cases where there is a disruption of consistency in the
system established by the principles of substantive registration rights. Specifi c issues
pointed out in the paper are the competition of public registers (particularly in relation
with the constituent registration); special solutions in the order of priority; legislative
interventions that change the property law regime of real estates; and other. This paper
indicates debatable questions and demonstrates, on concrete examples, the complexity
of the discussed matter. In this sense, the conducted analysis may prove useful to the
legislator for the unifi cation of the registration rules.
