The paper presents the use of the institute of using someone else’s real property for the purpose of performing works as a right of property in court practice. In doing so, the author sought to draw attention to the most common problems that arise in
the conduct of such proceedings, which proved to be complex given the mandatory content of the claim, and sought to provide answers to certain legal questions.
