The market of road transport services in Croatia: do the roads lead to the EU?

Sažetak

The Law on Road Transport of 2004 was made in order to harmonize the Croatian Road Transport Law with Acquis Communautaire within the framework of obligations undertaken by Croatia in the process of its accession to the EU. The main objective of this normative activity has been to achieve liberalization of the Croatian market of road transport services, i.e. to create conditions for free market competition by the time Croatia becomes a full member of the EU at the latest. The final purpose of the new regulation has been to improve the quality of Croatian road transport activities which should be competitive on the common EU market. The article analyses in detail the new Law on Road Transport with respect to the realisation of these objectives, presenting also the relevant part of the Acquis communautaire that it had to be harmonized with. The article discusses controversial points regarding the realization of the objective and purpose of the new Law regulating Croatian road transport, and concludes that the level of actual harmonization is more along the lines of formal than substantial harmonization of this part of Croatian legislation with the Acquis. Along with the problem of organization of the road transport market services, the author analyses the revocation of a number of substantive-law regulations regarding the agreement on road transport in the earlier amendments of this part of the legislation which have not been remedied by the new law.
