HUMAN TRAFFICKING FOR LABOUR EXPLOITATION: STRUCTURE AND DYNAMICS OF THE LEGAL FRAMEWORK IN THE REPUBLIC OF SERBIA

Sažetak
The majority of academics and experts problematize human trafficking for labor exploitation as a phenomenon related to irregular migration and state security, and the United Nations Protocol to Prevent, Suppress and Punish Trafficking in Persons, which supplements the United Nations Convention against Transnational Organized Crime, defines it as such. While this view marginalizes the concept of human trafficking in terms of violations of human rights and human security, this protocol has defined the very notion of human trafficking within the international legal system and, albeit heavily criticized for being too general and not easily operationalized, it launched the fight against this crime and enhanced the formulation of strategies and obligations that countries have in relation to the provision of victim support and assistance. The paper situates the issue of human trafficking in the context of labour exploitation, and focuses on the analysis of the legal framework that developed in the Republic of Serbia in the last ten years. In conclusion, the author introduces the most recent international and regional legal instruments aiming to facilitate timely and efficient combat against human trafficking for labour exploitation.
