Sažetak

The independence of courts is one of the most important pillars of the rule of law. This can primarily be achieved if the division of executive, legislative and judicial powers operates without exception. Implementation of this principle is often seen as the measure of development of a country's democratic system. In most democratic states, the Judicial Council has become an independent entity accepted for increasing the independence of the judiciary by removing power over the appointment of judges by the executive authority and putting this power in the hands of a body consisting of judges and representatives of other branches of authority and professional associations. Therefore, this study will analyse the role of the Judicial Council in the appointment of judges in the Republic of Croatia and in some other countries of the European Union.
