Sažetak
The Madrid Criterion was set in 1995 for the fifth EU enlargement circle. The European Commission highlighted its elements in its annual progress reports for individual candidate countries. The basic requirement is that public administrations of the candidate countries have sufficient capacity that can sustain and support the previously established criteria – political, economic, and legal. Since the criterion’s role is instrumental, the European Commission was satisfied if the basic elements of the criterion of administrative capacity were implemented – it was enough to adopt a majority of requirements with regard to enacting and amending legislation in certain parts of the administrative system. This conclusion has been confirmed by an analysis of the demanded and conducted administrative reforms in the Czech Republic and Slovenia in five distinct areas: structure of the public administrations, local self-governments, civil service, administrative functioning, and the protection of citizens’ rights vis-à-vis public administrative bodies. A similar analysis of the Croatian public administration and accession negotiations has shown that the criterion of administrative capacity
is now rather stricter – additional requirement is the implementation of the new administrative legislation.
