Difficulties in collecting a claim as a basis for granting an arrest according to the International Convention for the Arrest of Ships, 1952
Đorđe Ivković
Sažetak
According to the [Croatian] Maritime Code and the Execution Procedure Act, later difficulties in collecting a claim have been shown in order for an arrest to be granted.
The International Convention for [the Unification of Certain Rules relating to] Arrest of Sea-going Ships [''Arrest Convention], 1952, does not require showing of these difficulties.
The author gives a short analysis of foreign and Croatian jurisprudence and concludes that the Convention should be applied to ships flying the flag of a non-contracting State in case of an arrest in the Republic of Croatia.
