Shipbuilding in the Maritime Code

Sažetak
The author analyses the provisions of the Croatian Maritime Code constituting shipbuilding law, which regulates construction, repair and reconstruction of ships in shipbuilding yards. He discusses the provisions regulating public and civil law relations in shipbuilding industry.
The public law aspect of shipbuilding industry concerns the relationship between the state, on one side, and the ship builder and the shiprepairer on the other side, as undertakers of shipbuilding and shiprepairing activities in shipbuilding yards. The civil law aspect of shipbuilding industry concerns the shipbuilding, the shiprepairing and the shipreconstructing contracts, which are made between the shipbuilder and the shiprepairer on one side and the orderer on the other side.
The author concludes his review of public and civil law provisions by focusing on their application in the Croatian shipbuilding yards which are situates within shipbuilding ports. The author's opinion is that these ports have a special assignment under the regime of the public maritime good. He apostrophes shiprepairing ports which are situated within merchant port open for the poblic sea traffic, and which are under the regime of the port open for the international sea traffic.
