Final draft of the new convention on salvage at sea and the new solutions adopted

Sažetak
Although the 1910 International Convention on Assistance and Salvage at Sea is one of the most widely accepted unificatory instruments in the field of maritime law, the time has come to draft a new, modern instrument. This is a result of the development of maritime technics and technology which have resulted in diminishing tha dangers that threaten ship and cargo, but also in the increasing costs of salvage operations, lager fund of salved value, greater ecological threat to marine environment etc.
In this paper the 1981 Draft convention of the CMI and the 1988 Draft of the IMO Legal Committee are compared, the latter being that which will be considered at the forthcoming diplomatic conference. Some aspects as incorporated in the final draft are: wider scope of application of the Convention, explicit non-application to raising of sunken objects, enumeration of duties of the salvor and duties of the owner and master of the vessel or other property in danger, clearer relations among the property interests in cases when national law provides for payments of reward in proportion to the value of these interests. The view is expressed that this text of the Draft will be adopted at the Diplomatic conference in April 1989 in London.
