Evidence From Abroad From the Position of the Defence: Possibility of Obtaining and Controlling the Legality and Reliability of Evidence

Sažetak
One of the characteristics of societies of the 21st century is the increasing freedom of movement of people, goods and services. This has consequences in the field of evidentiary law, in that an increasing amount of evidence is located in a state that is different from the one in which the proceedings are conducted. Cooperation between states in the field of gathering and exchanging evidence has developed gradually, from the model of international legal assistance, to mutual recognition, which is now widely applied in the European Union. This paper provides an overview of the most important legal instruments in the field of gathering and exchanging evidence between states, especially in the context of the position of the defence.
