Future of Digital Tracking: Challenges and Opportunities in the Regulation of Cookies and Related Technologies in Croatia

Sažetak
The paper presents comprehensive research on the compliance of cookie notices in Croatia with regulations and best practices, while examining broader aspects of digital privacy and advertising in line with the latest technological, regulatory and other key initiatives. The paper analyzes the EU and Croatian legal framework, with a synthesis of key elements crucial for understanding the topic and context of the Croatian regulatory environment, with a special emphasis on recent domestic practices and first fines (2023). A further study on cookie notices on 55 Croatian websites reveals significant differences in transparency and compliance with regulations, with widespread use of dark patterns and improper use of the legitimate interest basis.
Further research into current developments, such as the Cookie Pledge initiative, Google’s Privacy Sandbox, and the trend toward limiting third-party cookies in web
browsers, points to a future direction toward user-centered practices, greater use of
alternative digital tracking methods, and adjustments in digital advertising practices. Along with providing contemporary insights and guidelines for a wide range of stakeholders in the digital ecosystem, this work encourages a proactive approach to adapting and enhancing practices in line with the analyzed changes, and promotes further interdisciplinary research through recommendations and guidelines.
